You were taken to the draft board and they want to send you to war. What if you don’t want to kill and die? Instructions from human rights defenders

The most important thing is that it is possible not to go to war, it is legal and real, but this requires your desire, efforts and persistent struggle.

It is important to remember that the draft board and the army are not a prison, and you are not a criminal. Don’t give in to threats! You have rights and you can and should protect them. Including the right not to serve. Make it difficult for the authorities to take every step it takes to send you to war.

And now an instruction based on the advice of human rights activists on what exactly to do if you somehow ended up in the military registration and enlistment office (voluntarily or not):

1. Film what is happening on video, record sound. It is legal! You have the right to film both the police and the military enlistment office, but you cannot take your phone away. Filming prohibition signs, threats and persuasion can be ignored.

2. Ask and record the positions and full names of everyone who makes any demands on you, and do not talk to those who did not introduce themselves to you. This is also legal.

3. Do not give away your passport and military ID. No one has the right to take them away – neither the police nor the military enlistment office. Do not give your documents to anyone, and if they have been taken away, demand that they be returned.

4. Keep in touch with loved ones, human rights activists and the media – tell everything that happens to you. If, nevertheless, you are threatened with the seizure of the phone, say loudly into the receiver: “If communication with me is interrupted, then [full name, position] interferes with telephone communication, exceeding his authority.”

5. Let us know if you belong to another recruiting office. After that, you should be issued an act of impossibility to serve the summons.

6. Write complaints about disagreement with the decision to call and demand that they be registered and accepted. Complaint templates are available here.

7. Demand to stop keeping you in the military registration and enlistment office – this is illegal, complain about it to the prosecutor’s office.

Самое главное: не идти на войну можно, это законно и реально, но для этого нужны ваше желание, усилия и стойкая борьба.

Важно помнить, что военкомат и армия — не тюрьма, а вы — не преступник. Не поддавайтесь на угрозы! У вас есть права и вы можете и должны их защищать. В том числе право не служить. Усложняйте властям каждый шаг, который нужен для отправки вас на войну.

А теперь инструкция на основе советов правозащитников о том, что именно делать, если вы каким-то образом оказались в военкомате (добровольно или не очень):

1. Снимайте происходящее на видео, записывайте звук. Это законно! Вы имеете право снимать и полицейских, и сотрудников военкомата, а отобрать телефон у вас нельзя. Таблички о запрете съёмки, угрозы и убеждения можно игнорировать.

2. Спрашивайте и фиксируйте должности и ФИО всех, кто предъявляет вам какие-либо требования, и не разговаривайте с теми, кто вам не представился. Это тоже законно.

3. Не отдавайте свой паспорт и военный билет. Никто не имеет права их забирать — ни полиция, ни военкомат. Не давайте ваши документы никому в руки, а если их отняли — требуйте вернуть.

4. Будьте на связи с близкими, правозащитниками и СМИ — рассказывайте всё, что с вами происходит. Если всё же вам угрожают изъятием телефона громко скажите в трубку: «Если связь со мной прервётся, значит, [ФИО, должность] препятствует телефонному общению, превышая свои полномочия».

5. Сообщите, если вы относитесь к другому военкомату. После этого вам должны выдать акт о невозможности вручить повестку.

6. Пишите жалобы о несогласии с решением о призыве и требуйте их зарегистрировать и принять. Шаблоны жалоб есть по ссылке.

7. Требуйте прекратить удерживание вас в военкомате — это незаконно, жалуйтесь на это в прокуратуру.

8. Повторяйте, что вы обжалуете решение по призыву и будете отстаивать свои права на альтернативную гражданскую службу(АГС).

Заранее сделайте доверенность на близких, которые будут представлять ваши интересы в государственных органах и судах.

Если доверенности нет — требуйте её оформить прям в военкомате, либо сделайте сразу же после выхода из военкомата. После этого ваш представитель должен подавать обращения в военную прокуратуру и суд.

9. Не проходите медицинский осмотр, не подписывайте никаких бумаг и не надевайте военную форму.

Распространяйте эту информацию — крайне важно, что бы о ней узнало как можно больше людей. Отправьте инструкцию своим друзьям или знакомым, а также распространяйте информацию в соцсетях.

Не ходите на войну. Не убивайте. Не умирайте.

How to file a claim to challenge the decision to call for mobilization

Make a power of attorney in advance for relatives who will represent your interests in state bodies and courts.

If there is no power of attorney, demand to issue it directly at the military registration and enlistment office, or do it immediately after leaving the military registration and enlistment office. After that, your representative must file appeals with the military prosecutor’s office and the court.

9. Do not undergo a medical examination, do not sign any papers, and do not wear a military uniform.

Spread this information – it is extremely important that as many people as possible know about it. Send the instructions to your friends or acquaintances, and also spread the information on social networks.

The response of the Ministry of Defense to one of the appeals regarding restrictions on the rights of citizens in the military registration and enlistment office (July 19, 2018) contains the following statements:

-Military commissariats are not military units

– Employees of the military commissariat are not entitled to conduct searches in relation to visitors, and searches can only be carried out with the voluntary consent of the visitor.

– Employees of the military registration and enlistment office are not empowered to seize and store visitors’ belongings.

– Restriction of the rights and freedoms of visitors to the military registration and enlistment office is allowed only to the extent necessary to ensure the safety of other visitors, the organization of official activities to protect state secrets, and also in order to protect the personal data of citizens registered with the military

(Obviously, as a regular visitor, you have no access to state secrets or personal data of other citizens)

Since 2018, the country’s military registration and enlistment offices have observed the establishment of bans on the use of personal phones with Internet access, bans on video and photo recording.

These prohibitions are not established by any Russian law.

Nevertheless, referring to the orders of the commanders concerning bans in military units, the military commissars happily transferred these bans to the military commissariats, allegedly because these are objects of the Ministry of Defense. Please note that the Orders of the commanders are not published in the public domain, because they are marked “For Official Use”.

But, as follows from the fragments that the military commissars submitted to the courts to challenge such bans, even in these Orders, the bans do not apply to all objects of the Ministry of Defense, but only to military units.

Neither in the museums of the Ministry of Defense, nor in the sports facilities of the Ministry of Defense, nor in the Military Commissariats have such prohibitions been established.

However, many military commissariats and draft boards are zealously trying to prevent the prohibition of video and photo recording.
