Article 207.3 of the Criminal Code of the Russian Federation

Dedicated to responsibility for the dissemination of deliberately false information about certain actions of the Armed Forces of the Russian Federation and state authorities. Such actions include those aimed at maintaining peace and security of Russian citizens.

According to the law, fakes are unreliable information, the distributor of which knows about its falsity and distributes it with a malicious intent. This information may concern, for example, the actions of peacekeepers, diplomats, international actions of state corporations or ministries.

Punishment:

  • a fine of up to one and a half million rubles or income for a period of up to 18 months,
  • correctional labor up to one year;
  • forced labor / imprisonment up to three years.

Part 2 Art. 207.3 of the Criminal Code of the Russian Federation

Provides for one of the following conditions:

  • use of his official position;
  • a group of persons organized or self-organized to spread fakes;
  • Artificial creation of evidence – text, audio, video, photographs;
  • selfish motives: for a reward, bonus, gift, and so on;
  • motives of hatred or enmity in relation to any social, religious or other social group.

Punishment:

  • a fine of up to five million rubles or income for a period FROM THREE TO FIVE years;
  • forced labor for up to five years;
  • Imprisonment for a term of five to 10 years.

The last two punishments are accompanied by deprivation of the right to hold certain positions or engage in certain activities for up to five years.

Part 3 of article 207.3 of the Criminal Code of the Russian Federation

It is applied if the spread of fakes has led to serious consequences:

  • major material damage;
  • stopping enterprises;
  • severe physical harm to human health (up to death),
  • occurrence of accidents and catastrophes.

Punishment:

from 10 to 15 years in prison + deprivation of the right to hold certain positions or engage in certain activities for up to five years.

Article. 280.3

It is applied if the accused has already been subjected to administrative punishment for publicly discrediting the Armed Forces of the Russian Federation or the actions of state authorities abroad during the year.

Punishment:

  • a fine in the amount of 100 thousand to 300 thousand rubles;
  • imprisonment for up to three years with no right to hold certain positions or engage in certain activities for the same period. At the moment, the list of positions or activities is not defined.

Part 2 Art. 280.3

Similar to the first part, but applies if such actions led to serious consequences.

Punishment:

  • a fine in the amount of 300 to 1 million rubles. or in the amount of wages or other income of the convicted person for a period of three to five years;
  • Imprisonment for up to five years with deprivation of the right to borrow certain positions or engage in certain activities for the same period.

Article 284.2

This article applies to citizens of the Russian Federation who have already been administratively punished earlier (within a year) for calling for the imposition of sanctions against Russia, individual Russian citizens, legal entities or individuals. At the same time, punishment is provided for such appeals directed both to states and individuals, as well as to interstate and public associations.

Punishment:

  • a fine of up to 500 thousand rubles or in the amount of the convicted person’s income for a period of up to three years.
  • restriction of liberty for a period of up to 3 years, or forced labor for a period of up to three years.
  • Arrest for up to six months.
  • imprisonment for up to three years + a fine of up to 200 thousand rubles or in the amount of the convicted person’s income for a period of up to one year is possible.
